Leave for victims of violence against women and their children is a statutory benefit under Republic Act No. 9262. Qualified victim-employees may take up to ten days with full pay, and longer when a protection order specifies the need, to attend to medical and legal matters connected with the case. What the leave is for
The handbook describes the benefit as paid leave for a female employee who is a victim of VAWC, so she can attend to medical and legal concerns at any time during the application of a protection order, investigation, prosecution, and/or trial of the criminal case.
RA 9262 defines VAWC in statutory language that includes physical, sexual, psychological, and economic abuse in the relationships the Act covers. HR does not need to restate those facts in a leave ticket. The operational fact is that a qualified employee has presented the certification the rules require and needs dates off with pay.
The leave is in addition to other paid leaves under labor laws, company policy, and CBAs. Do not charge it to VL, SL, or SIL.
Duration and pay
Qualified victim-employees are entitled to up to ten days with full pay, consisting of basic salary and mandatory regional wage-board allowances, if any. Confirm that pay definition against the current handbook and your wage structure.
The ten days may be extended when the need arises, as specified in a protection order issued by the barangay or the court. An extension is not a supervisor’s informal extra week. It follows the order. Record the extended dates the same way you record the original ten: type, dates, pay.
Usage of the ten days is at the woman’s option. Operations may ask for as much scheduling notice as the situation allows. They should not refuse the leave because the team is short-staffed, and they should not require the employee to exhaust VL first.

The certification, and nothing extra for curiosity
The handbook states that the only requirement for entitlement is a certification from the punong barangay, barangay kagawad, prosecutor, or Clerk of Court, as the case may be, that an action relative to the matter is pending.
That sentence should restrain intake forms. Do not add fields for the alleged offender’s name, a free-text incident story, or photos “for the file” unless counsel has told you a specific employment process needs them. A public blog should not encourage that collection, and software should not invite it by default.
If a protection order extends the leave, keep the portion of the order that states the dates or the need for extension. You still do not need the rest of the case file in the payroll folder.
Confidentiality and access
People who approve ordinary VL do not automatically need to read a VAWC certification. Design access so that:
- The employee can request the leave
- A limited HR role can see that the certification was received and that dates are approved
- Supervisors who only need coverage see that the person is on approved leave, not why
- Payroll sees paid leave dates, not attachments

DTR and payroll
The DTR should show VAWC leave (or the discreet internal code you use for that type) for each date, not unauthorized absence. Payroll pays full pay for those days. A payroll computation that drops the days because the type was unknown will look like a denial of the statute.
Holiday calendars still exist. Write how a VAWC leave day that falls on a regular holiday is treated, consistent with your other paid-leave rules, and apply that rule quietly.
How to calculate leave credits is mostly about accruing VL/SL/SIL. VAWC leave is event-based. You do not accrue ten days every January for the whole workforce. You record entitlement when a qualified request exists, and you do not carry unused days forward.
What supervisors can say
A practical script is enough: the request is approved as paid leave; coverage will be arranged; questions about the file go to HR. Supervisors should not ask the employee to justify the underlying case. They should not contact parties named in any paper they should not have seen.
If someone in the workplace is the respondent in the same matter, separate attendance administration from safety measures. Safety planning is not a leave-code problem. Get qualified advice. Do not handle it through a leave remark.
Records retention
Keep the certification, the approved dates, any protection-order excerpt that supports an extension, and the payroll evidence that the days were paid. Retain them under the privacy policy and legal-retention rules you already use for sensitive HR documents. Do not keep extra copies in email inboxes.
When the ten days and any ordered extension are finished, close the request. Do not leave a standing “VAWC balance” that looks like VL on a report everyone can export.
Year-end conversion batches should skip this type. If a protection order later specifies more days, open a new approved range rather than recycling an old unused balance from a prior year. The handbook describes the unused benefit as non-cumulative.
Scheduling notice and coverage
The employee may not be able to give long notice. Hearings and barangay conferences move. Approve dates against the certification and any order, then arrange coverage. A denied request “because the roster is full” is the wrong first answer when the statute grants the time.
If only part of a day is needed for a hearing, decide whether you allow hourly VAWC leave or require a full day. Write that rule so the employee is not forced to spend ten full days on four-hour appointments without a stated policy.
Do not require the employee to use VL for the first days as a “goodwill” condition. The leave is in addition to other paid leaves.
Workplace safety is not a leave-code comment
If the alleged respondent works on the same premises, leave administration and safety measures must be separated. Changing shifts, limiting contact, or following a protection order are management and legal questions. They do not belong in a leave remark that payroll clerks can export.
